As the Munich Oktoberfest is still in progress, a Frankfurt Court made a stunning decision: Hangover will now be recognised as a disease.

A beverage company that claims its products have anti-hangover qualities has been sued, being accused of selling products and claiming that they can heal hangovers.

“A fruit-based product cannot have properties for the prevention, treatment or cure of human disease and it cannot give the impression, that it has these healing properties” decided the regional supreme court of Frankfurt (Oberlandesgericht), and clarified: “disease can be understood as temporary changes in the state and normal activity of the body.”

Included in this category are fatigue, nausea, headaches or symptoms associated with hangover, which the company claimed that its products can cure.
